For consumer class-action counsel, paralegals and pricing experts

What the product page charged, day by day, behind the 'was' price

RivalSweeper records the price on a product page every day, with date, URL, market and currency, and sets each 'was', 'compare at' or '% off' claim against what the page actually charged. The evidence pack is scoped to the products and period in your matter.

17501

California Bus. & Prof. Code §17501 ties an advertised former price to the prevailing market price in the 3 months before the ad, unless the ad states when that price applied.

Hinojos v. Kohl's Corp. (9th Cir., 21 May 2013): a shopper who buys because of a false former price, and would not have bought otherwise, has standing under California's false advertising and unfair competition laws.

Why now

A reference-price case turns on a price history nobody kept

Was the 'was' price ever the price the product was actually offered at, for long enough and recently enough to count? The answer is a daily price history for specific products across the class period, and before discovery the retailer usually holds the only copy. Counsel start with a few screenshots and an archived page.

The tests are about time. The FTC's guides ask whether the former price was openly and actively offered for a reasonably substantial period; California's §17501 looks to the prevailing price in the three months before the ad. A screenshot proves one day. It does not show how long a 'compare at' price stood or whether the sale ever ended. Defense counsel answering a demand letter face the same gap from the other side.

Without it

  • Manual screenshots and the Wayback Machine: Free and familiar. A screenshot proves one day; archive captures are irregular and may miss your products and dates.
  • Waiting for discovery: The retailer's data is the fullest source, but it arrives after filing, on the other side's timetable.
  • Enterprise price-intelligence suites: Built for retailers' pricing teams on ongoing subscriptions; not scoped to a per-product record for one matter.

With Discount Evidence Record

How it works

From a free call to an evidence pack

  1. 1

    Free, confidential first call

Name the retailer, products and period. We check whether those pages are already recorded and from what date.

  2. 2

    Scope and quote

Products, markets, date range and the claims to test are agreed. One clear quote before any work.

  3. 3

    Record pulled, claims recomputed

Daily prices per product, each claim set against them, the discount recomputed, and how long and how recently the reference price was charged.

  4. 4

    Evidence pack delivered

One record per product with a method note listing every gap. Counsel and experts decide how to use it.

What it does

Features

Daily price record

Full price, current price and stock status per product page, captured daily with date, URL, market and currency.

Reference price vs prices charged

Each 'was' or strikethrough price set against what the page charged, so you see whether it was ever the selling price.

Former-price duration and recency

How long the reference price was charged on recorded days, and when it was last charged before the ad.

Recomputed discount

The stated '% off' recalculated from recorded prices and shown next to the claim.

Strict comparison rules

A change counts only when source, market and currency match; a jump of more than 5x is not treated as a price move.

Gaps disclosed

Days with no observation are listed in the method note. Nothing is interpolated.

What you get

What each product record contains

Packs are confidential to the matter, so no sample is published. Every product record follows this structure.

Built for

Who it's for

Plaintiff-side class-action attorneys

Vet a pre-filing investigation: did the reference price hold up across the class period, before discovery reaches the retailer's records?

Paralegals and pricing experts

One structured record per product instead of a screenshot folder. Note its scope: offered prices on public pages, not transactions or sales volumes.

Defense counsel reviewing a demand letter

If your client's pages were recorded, test the allegation product by product: what was charged against what was claimed.

Security and data

  • RivalSweeper reads public product pages only; no access to any store, ad account or analytics is needed.

Questions

Can you show prices from before tracking started?

No. For stores already monitored the record goes back to when tracking started; for a new store it starts the day it is added. We tell you what exists on the first call, before any quote.

Will the evidence pack be admissible?

We do not promise admissibility in any court; that is for counsel to decide. Every price traces to a dated observation and the product URL, and the method and gaps are written down.

Is this legal advice?

No. This is not legal advice; RivalSweeper is not a law firm. We record public prices and do the arithmetic; whether a reference price was lawful is for you and your experts.

What if the claim ran in an email or an ad?

The record is built from public product pages. Tell us where the claim appeared and we will say plainly what the record can and cannot show.

Can an expert use it for damages work?

It is a daily series of offered prices with a stated method. It does not contain sales volumes, transaction data or checkout prices.

We act for the retailer. Can we use it?

Yes. The pack can check your client's own promotions as well as other stores' public pages, if those pages were recorded for the period.
